Course description
The course of Private Law relates to the basic concepts of private and civil law in general. The program includes the entire private law through the study of the content and the systematic structure of the Civil Code. From an academic point of view, the course is designed to provide a basic and complete understanding of the institutions of law of individuals, bodies and family law, inheritance, property, obligations and contracts, liability and torts), as well as the introduction to the system of legal sources and legal terminology.
Objectives
The course of Private Law focuses on the right of individuals and entities in the national framework perspective. The program includes the entire private law through the study of its schools, according to the systematic structure of the Civil Code. Primary source of private law is the Civil Code. The study of the institutions of private law is therefore mainly the study of the Civil Code. The course of institutions of private law is placed in the first year. During the course, students must study all video-lessons and the civil code (in order to better understand the lessons). From an academic point of view, the course is divided into an introduction, five modules and two master classes, targeted to specific degree courses. Module A (Introduction – Individuals and entities - Family – Will and Inheritance - Property). Module B (Obligations - Contracts – Torts and Liability). Specific lessons.
Program
Primary source of Private Law is the Civil Code. The contents of the Course can be summarized in educational areas (see also the Conceptual Map), as follows: - Introduction to Private Law; - Rights of persons; - Family Law; - Will; - Property rights; - Obligations; - Contracts; - Torts.
Book
The Civil Code, the Italian Constitution, the Community Treaties and the main special laws. Several publications f the Civil Code are commercially available and appropriate. The reading of the Code must be accompanied by the study of one of the following volumes: V. Franceschelli, Private Law, Milan, Giuffrè (latest edition); F. GALGANO, Institutions of Private Law, Cedam, Padova (latest edition); P. TRIMARCHI, Institutions of Private Law, Milan, Giuffrè (latest edition); V. Roppo, Institutions of Private Law, Bologna, Monduzzi (latest edition).
Exercises
Written thematic essays are already uploaded upon video-lessons. The student is required to make five exercises, at her/his choice, in order to be graded and evaluated in his understanding of video-lessons, prior to the admission to the final exam.
