On Thursday, Oct. 27 and Friday, Oct. 28 starting at 09:00 a.m., the conference "Understanding National Security Concerns in Light of FDI Screening" will be held in Rome. The event organized by the International Telematic University UNINETTUNO, together with the CELIS Institute in Berlin and the University of Uppsala, will feature distinguished national and international guests. Among others, Dr. Neena Malhotra, India's Ambassador to Italy; Prof. Maria Amata Garito, Rector of the International Telematic University UNINETTUNO; Andrea Sacco Ginevri, Full Professor of Business Law at UNINETTUNO Faculty of Law; and Steffen Hindelang, Professor of Commercial and International Investment Law at Uppsala University, Sweden, will be attending.
This event will provide an opportunity for comparative and in-depth discussion of the very timely topic of national security and foreign direct investment. In the context of economic and geopolitical uncertainty, several countries within the EU enhanced foreign investment screening to safeguard domestic capabilities related to healthcare and protect strategic interests. On the other hand, the EU believes that some foreign investments can often pose a risk to security and public order.
This conference will address concerns about the lack of legal certainty in the implications of screening FDI for reasons of "national security," "strategic interests," "critical infrastructure," "public order," and similar concepts. It will also help practitioners and scholars understand or delimit the broad understanding of these fundamentals of FDI screening and discuss what the best approach should be for understanding these parameters as they are used.
